Hard to believe your OEM tires are that worn at 38K...we had to replace ours before turn-in, but we're turning in at 53K, and we put new tires on the car, mainly because we're going on a long trip just prior to lease-end. (Got Kumho ECSTA HP14s- nice tire) The irritating thing about the tread-depth standard, and all the other things specified for turn-in, is that all this information was only sent to us about six months ago. As far as when we leased the car, the ohly thing they said was something to the effect that we were responsible for scheduled maintenance. Reviewing these things at the outset would take only a few minutes, and that way the customer would know everything up front.
The only specious thing that is specific to tire wear is that if one invokes a standard of "reasonable condition," then it would be perfectly "reasonable" that a 3-year-old car have worn tires. After all, I can turn in the car with brake pads that are worn down to the backing, and no one will say anything. But, in effect, they have written their regulations so that in most cases they will get a nice new set of tires on the used car when they peddle it. We considered the used-tire dodge, but rejected it. I don't like trusting my life and the lives of my family to four patches of rubber about the size of my hand unless I know where they've been.
