All of my 900 cars have made a whine while decelerating in 2d gear. I also find shavings on the drain plug when I buy a new used saab. Biger bits of metal mean trouble, but shavings are not necessarily indicative of a dying piniuon bearing.
Try this: drive in fourth or 5th up a hill, at lower than normal RPMs. Listen for a whine: do you hear it? If yes your trans will die, if not the pinions are in OK shape.
You do, of course have legal rights. Look into the Warranty section of the Uniform Commercial Code, 2-3XX, if memory serves, and Texas state law warranty law.
