Here's the problem: In California, the law says that you may have up four, forward-facing white or yellow lights on at any time. That was surely intended to be low-beam+fog and high-beam+driving. Unfortunately, the ability to pick out a driving light vs. a fog light vs. a pencil light vs. a spot light is probably pretty difficult for enforcement, so most people get away with minor infractions.
Rant: Complicating the fact is that you have people like Chrysler putting "driving lights" on so many of their cars that don't really do anything - yeah, they're lights but they're aimed improperly to be fog lights and aren't bright enough or far-reaching enough to be driving lights. My sister has these on her Sebring - I can't figure out what they're for other than decoration.
Back to the point: I imagine the CHP's job here is complicated, since auxiliary lighting doesn't have to meet the same specifications as main lighting. There's quite a bit of variation in what a manufacturer claims its products will do vs. what it really does. You can probably get away with most anything so long as you don't have more than four lights and you aren't blinding anyone.
For me, in response to SPGuy, I would rewire. Driving lights that can't be used in combination with high-beams don't make much sense. Properly aimed, driving lights in combination with standard high-beams make for some serious road coverage - one pair of lights can't do thar job adequately IMHO, especially if, like me, you find yourself driving spiritedly in the night from time to time.
