And your "tank" did not get totaled? The Orkin man's company insurance will probably require you to get a few estimates to repair the damage on your car. If he was clearly at fault, I don't see you having to go to court at all.
If his insurance company pushes the "damage exceeds the value of the car" bit. Show receipts of recent work done to the car. They will try to low ball you, but don't settle right away. Injuries that occur in an accident may not show up for a few days or weeks. They'll want you to sign off ASAP so you can't come back on them for personal injuries later. The longer you hold off, the more they may offer to settle the claim. Tack on rental car expenses also, but they may only cover that for a week.
I had a similar experience years ago when hit by a business' vehicle and had my car totaled. They tried to low ball me for like a $1000(book value). I ended up getting something like $2300 after a few weeks of fighting with the insurance company.
