Every time I have been in an accident it was pretty much my fault, except one time when it was clearly the deer's fault but he was uninsured (and very dead). In any case, I never have really had to deal with this issue but I have wondered about it. I have heard many horror stories about dealing with insurance companies underpaying for damaged cars. It seems to me that I shouldn't have to do all the work when it was their client that hit my car. I would try telling the insurance company that I didn't really care how much they paid for it, but I just want another car, just like the one I had (or very close to it), delivered to my driveway (don't bother getting it detailed I'm going to do that myself anyway, thank you very much).
I've wondered how many supervisors I would have to be transferred to before they gave me a definitive answer on that. If you try this tactic be sure to threaten to file a complaint with the state insurance board (or whatever regulatory agency your state has for insurance company oversight), and do it if they don't work with you. Most people I've talked to have pretty much just bent over and let the insurance company screw them without much of a fight. Generally it is because they really needed to have a replacement car right away. I would go out and buy a $300 junker to drive until you can work out the details with the insurance company.
In fact, I happen to have such a car in my driveway right now. It is a white 1985 900T with deteriorated burgundy leather seats, a screeching harmonic balancer, a few "minor wiring issues" keeping the fans from turning on and badly in need of a new paint job. Other than that it is in great shape LOL!
