The GARRETT T3 turbocharger oil seals are carbon steel piston rings which have a gap of up to .013" when new. This gap increases over time/use of the turbocharger and will allow for oil past the seal.
Engine rpm is relative to oil pressure/volume and a warm engine will see a lower oil viscosity making for different oil bypassing symptoms under different engine temperatures or engine rpm.
A new turbine seal may be needed (we also use 360 degree oil seals) to reduce the bypassing but you might also check the turbocharger rotating assembly for movement (check for in/out movement of the shaft as well as up/down) as there should be minimal movement. If movement is substantial, the turbocharger may be in need of an overhaul which would replace bearings, thrust assembly, oil seals, etc.
