You can do whatever you want with a car within 90 days of the smog - buy, sell, register, whatever... if it was done in January, it's current though March. Know also that you can only renew your registration within three months of expiration, and in fact you must renew if you're registering within three months of expiration. If your tags expire in April, you'll have to pay for next year's (09) renewal when you register, but at least your January smog will be current. I'd head over to the DMV and get it taken care of now.
