91 9KT brakes overheating

I had my rear brake pads replaced at a Midas three weeks ago, and over the last three or four days I've noticed the rear left wheel frame heating up to the point that I smell burning absestos when I get out of the car. My commute is about 20 miles in the morning and evening, with about five of those miles in stop and go traffic. When the wheel heats up, towards the end of my commute, the brake starts squeaking all the time, even when I'm not braking. The tricky part about this is that the rotors are perfectly unscratched, the pads seem brand new (only three weeks old) and the caliper doesn't appear to be rusting away. Plus, only the LEFT side is heating up and squeaking. What in the hell is going on? Should I sue Midas? Any suggestions AT ALL are greatly appreciated.
