Two years ago on Valentines day I was ran off the road by a Ford f250 that turned into my lane after crossing two other lanes. I was in our 95 900vert, I hit a curb that broke the left front wheel and pushed it back and into the foot well. The rim was parallel with the ground.the convertible top frame got tweaked. When dealing the the other drivers inusrance (State Farm) they tried to put us into a Ford Focus. Now my girlfriend has 3 teenage kids from a previous marriage that are as tall as me 5'9". Needless to say they werent going to fit into that sardine can. I called the insurance company and advised them that we were going to need something slightly larger than that and I was told that was I was getting. i promptly informed them that as I was the one driving the car when the accident occured and that there was no way that I was about to ride around in a car that wasnt comfortable. I let them know that they could either get us a different car or I would call my lawyer and he would take care od it. I got off the phone with them and within 30 minutes got a phone call backl asking what time was convenient for them to come by and pick me up and get a different car. They put us in a Nissan Pathfinder. When they balked at having to repair the top after my mechanic said that the force of hitting the curb at ~40mph had tweaked the top and caused the gears to not mesh properly I had to do the same thing, I just politely told them look Im not looking to get rich here or get a new car, all I want is my car back teh way it was before the accident and that if they didnt agree with that then they could work through my lawyer while I promptly went to go see a doctor as I hadnt been checked out since the doctor yet. Took a little longer but within an hour they called me back and I asked them to politely hold as I had my lawyer on the other line. When I finally did speak with them they told me that after speaking to their internal mechanics it was a possiblity that the top had been damaged in the accident and that it would be covered. they also replaced my rotors all the way around because the left front was cracked almost straight across and it just wouldnt make any sense to replace one without doing them all.
Mind you, I never called a lawyer but if things had come push to shove I was more than willing to call a lawyer. I work for the nations largest group health insurer so I have a firm grip on the various workings of insurance. 95% of first denials get overruled with a little pressure from the outside ie: customer, claimant, lawyer, Insurance Commissioner...always bluff lawyer but be willing to back it up with one as well. Dont get taken.
