Difficult to say anything about liability. Your mechanic might have just tried to be nice and not racking up the cost too much thinking the cable looked new enough to be reused.
If I do a clutch assembly nowadays on these cars I have the customer sign a release of liability IF, they want to keep the old clutch cable in there.
If they agree on replacing the cable with a new one, I leave the full 12 month/12K mile warranty if I supply the parts.
I would never replace a clutch anymore without bringing up the possibility of a failed cable later on if not replaced together with the clutch.
I have seen clutch cables that were less then a year old, break soon after the clutch was replaced. That's why I have the policy now to always replace the cable with the clutch assembly.
