I've run K&N filters on my last 3 9-3s without any issues whatsoever and my dealer doesn't have a problem with them either. In fact on my other car (2000 Chevy Tahoe), the GM dealer actually sold us a K&N and fitted as part of the PDI!
K&N will back you up if you contact them - I strongly recommend that you do.
What the dealer is suggesting is BS (excuse my latin), since it's physically impossible for the tiny amount of special filter oil to migrate in any quantity that would affect the O2 sensor enough to produce an out of range error condition. The only thing I can think of involving the K&N is that, it could be so dirty as to restrict airflow and thus cause an error condition - but I'm sure you've already checked that.
