Ideally everything is supposed to stay fixed the first time. Seems like this happens only to the folks with the highest expectations. Please don't be offended by the dealer inquiring as to how you drive. With driveability issues, you gotta' ask.
Shifting at 3-3.5k rpm shouldn't ever cause a problem. You shouldn't have to do an "Italian tune-up" and rev the car up to avoid driveability problems. On the other hand, high performance DOHC 16V motors sure don't mind a blast up the rev range to clear the pipes and people who drive the cars hard experience less driveability issues, but zero driveability issues is the norm for either.
Duplicating cold start problems takes time. Morning cold starts can't be duplicated all day. Try not to get too disgusted and pay attention to the symptoms and when they occur and drive the car with the service advisor and do be able to demonstrate the problem.
One unscheduled visit is unfortunate, the second visit even more so, but your a long, long, long way from any Lemon Law protection. That takes 4-6 trips and so many days out of service and then the arbitrators and referees and so on. Used to be a couple of unscheduled "teething" trips to the dealer was the norm for all cars, but not lately.
Can you hang with it until the 30 day service? Or take it in right away and have them do the 30 day svc at 22 days, that'll save you a trip.
I wouldn't scream bloody murder until at least after the second visit to fix a problem.
