It's never the timing belt that fails. That is a secondary effect of something else that failed.
It could be one of the three roller bearings that failed.
It could be the rubber gasket from the timing cover that got sucked in and winded up around the timing belt.
It could be one of the cam shaft sprockets that came loose.
Find the two invoices from 35 and 65K service and check them carefully if at any of those two times the whole timing belt and tensioner assembly was replaced.
If they didn't replace the whole kit and cabooble at any of those two times, you might have a slight chance of stating that they didn't perform the complete timing belt replacement as outlined in a bulletin that was sent out in 2001.
But since it is a whole new engine in there, my guess is that it have the latest tensioner pulleys already and it might be difficult to get any help.
So when did the engine go out in this time line? Was it between the 35 and 65K or before the 35K replacement?
Don't give up without a fight, stranger things have happened.
