Yes, the issue here is that it could not be determined what the fault was. Sensor, computer, airbag, wiring. The car clearly thought it had just been t-boned.

Liability is not to dealt with lightly. The manufacturer inspected the vehicle and basically told the owner to take the car off the road and buy a replacement. It is far cheaper for them to pay now then to have the possibility of having to pay millions of dollars years later.

That liability now shifts to the owner, if they put the car back on the road. I am actually surprised they did not make him sign a document stating that the car was not to be driven any more. But I suppose totalling the car is essentially the same thing.

DON'T touch this with a 10-foot pole. Airbags have been PROVEN over and over and over to save lives and prevent serious injuries. I was in a wreck recently at ~45MPH and due to having my seatbelt on tight and of course the airbags deploying, I literally did not even feel the car hit. With no airbag, I surely would have had a neck and/or head injury of some sort. I had no bruises, headaches, etc. and basically it felt like nothing happened.

Now, assume you replace the seat with a junkyard seat, you will have full liability for any injuries to your passenger if the airbag does not deploy. Even if you replace the airbag with a NEW one (very expensive), you are STILL liable because the MANUFACTURER said the car had other issues that they could not fix.

A track car will be modified for off-road use and will have a roll cage, safety harness, helmet restraint, etc. So that is really the only way this car could have a future, IMHO.
