If the curved spring is not seated properly wrapped over certain points of caliper, the caliper will tilt making this happen.
But usually you will end up with a soft brake pedal since the caliper will tilt back into position for every brake pedal stroke.
I have seen that many times when DIY or other shops have done brakes.
Another possibility is if the brake pad is not the correct one and these have a dowel pin on the backing plate that does not fit into an opening of the caliper.
Volvo XC90 with big or small brakes have that problem if you install the small pads in a big brake caliper or vice verse.
