Many wouldn't have of course. Ultimately people do have limited budgets. In these cases it really is hard to argue that anyone has been harmed. Nothing is nothing either way and there is no physical lose. Of course it undoubtedly impacts actual purchase behavior too which can be seen as a legal harm. I also think the posts that second hand recordings can increase awareness and result in future sales probably does still have some truth although I think easily available and fast internet downloads have reducded this sigificantly.
The above should not be taken as any sort of defense of the wide spread illegal exchange of copyright protected materials that p2p enables nor do I engage in such exchange. Just an observation that I think undercuts the extent of the industries claimed financial damage. On the other hand some of the arguements posted here are really rather silly too. It has been justified on the grounds that the product is crap, some of the parties are engaging in typical business BS (in some cases illegal), or recordings are too expensive. Perhaps all true but if you don't like what is being offered you can treat it the same as any other product. Most stuff that is sold is crap and too expensive.
That said, I do think potential penalties for non-commerical exchange are way unreasonable when compared to other things. Also I do think we need to do something to re-establish reasonable copyright fair use, which has been significantly eroded over the last 20 years, and to extend it to digitial assets. For instance, simply playing recorded music as background music in a small business should be fair use as long as you have a legal copy. Likewise, using it as background in personal vido, even if posted to the internet, should be fair use if you have a legal copy. However, the most important thing is being able to use copyright protected materical for critic, commentary, research, and discussion without excessive restrictions.
