Many years ago there was a truck (flatbed of some sort) that lost a few small machined parts or something onto the highway. I ran over one which cut deep into the tread of still relatively new tire and caused the hub cap to come off and roll away into the ditch never to be seen by me again.
I was able to get a name off the side of the truck and called the local sheriff. He actually came out looked at the car then tracked down the trucker. The sheriffs department called back and said that the trucker indicated (based on reactions/gestering of other drivers around him) he may have lost something off the truck. They gave me the guys number and told me to call him concerning the damages. They also indicated that they could threaten a citation for failure to secure load if there was a problem. Not that there were any problems. They probably would have readily paid for a brand new tire plus the hupcap. However, as a college student student with an older car I didn't care about I proposed ignoring the hub cap to offset the use I did get from the tire as long as they paid the full cost of a new tire and installation.
Your situation is a little different since doesn't fall under insecure load or something. Also I would guess that someone that has a tire that has failed and then leaves there car sitting for 2 days might be hard to collect from and assuming they are insured hard to say how an insurance company would react.
