I have heard of things like this in the past. It seems that if the tenant finds a replacement they are entitled to get their money back, but if the up and leave it is abandonment and you get to keep the money. Since the appartment was rented for the December the tenant does have the right to ge their money back for the last 12 days of December. You can't rent the same place to two different parties at the same time. You will need to send the old tenant a check for the 12 days of rent that they did not use. It is not like you lost any money. You don't want to pay lawyer to get you out of this.
