First of all, is it legally enforceable, as in court? Can a company legally place a retroactive condition of employment on employees that curtails personal freedom? I dunno, but it seems made for a lawsuit. Seems they could require it of NEW employees, but I question if they can legally do this retroactively. And how are they checking? Random blood tests at work? And if that is what they do, suppose the blood test shows up marijuana, or clove cigarettes, instead of tobacco? How do they play that one? Or suppose someone chews instead of smokes? What if someone enjoys an occasional cigar?
Next, is what comes next? Requiring a certain level of exercise, having weight requirements to eliminate overweight employees, or as others have noted, forbidding eating at McDonalds? Stipulating seat belt use? How about limiting alcohol use? Or how about if you get a speeding ticket, or have an accident in which you are at fault? These are all risky behaviors.
And could they eliminate risky activities, like rock/ice climbing? Skydiving? Bungee jumping? Driving a race car? Scuba diving? Riding motorcycles? Unprotected sex? Some life insurance policies forbid you to fly in private planes.
I am opposed to smoking and think anyone who smokes deserves anything that happens to them. And I am pleased that most companies are smoke-free zones these days. But it seems to me an employer is a bit over the top with a requirement like this, even though they are a healthcare business.
