There have been studies showing that smokers are less productive on the job than non-smokers, but to refuse to hire somebody on this basis might invite a lawsuit, as this may be true collectively, but not individually. That is, a smoker may be able to claim that they themselves are tremendously productive. But a smoker could not successfully claim that smoking is not bad for THEM, that individually they differ from the group as a whole. So if you're an employer and you want to maximize production by excluding a group that, on average, produces less, you claim you're doing it to lower health care costs. Will health insurance companies offer them lower rates because of this? I would be surprised.
