be authoritative on any of this but that is my understanding. In which case the BSD license should apply to the Apple's UNIX foundation. Although it also is an open source license the terms are very different and unless there is something much more going on I'd say Apple is not under any obligation to open it up. Of course Apple also uses a lot of GPL programs as well. Maybe the arguement is that the O/S is tained in some way in which case the GPL might apply. However, without knowing more I'd say Apple can keep it closed. Some of their other programs might be another story.
As far as the other stuff goes if it is really under the GPL they must make the source code available for free period. This is absolutely clear under the GPL. Doesn't matter if they do give the binaries away for free (they don't have to under the GPL) it is the source that matters.
