So as many of you know I _used_ to work for an emergency vehicle manufacturer. Long story but it's not a nice place to work any more due to a corporate buy-out and lots of negative changes so I left in October. I have an offer letter from 7 years ago that says if I ever leave I "will" get commission on everything I've sold that they've not yet built providing I deliver the vehicles, but that if I don't deliver the vehicles they will still pay me but hold "X" dollars ("X" is defined in the letter as a specfic amount of money for each vehicle).
Well, now that I've left I'm told by their VP of Sales that other employees are taking up too much of their time getting my vehicles built and that they're going to have to start keeping some of the commission on a case-by-case basis. The entire premise, by the way is total B.S. The only questions that come up for the most part are because they are incapable of reading their own production specifications and building what's already in writing and drawn in CAD. This is one of the reasons I left. So they self-generate their own problems, build crap product that doesn't comply with the spec, insist I drop everything I'm doing to come inspect trucks when they claim they are completed (they never are) and now are threatening to withold commissions on the fly as they see fit.
I'm certainly not going to take the time away from my new job working my a$$ off getting their screwed up vehicles delivered knowing they may take away a substantial portion of my commission if they feel like it.
My former college roomate is a lawyer but in another state and not admitted to the bar or intimately familiar with the laws here in Ohio. But he thinks I have a good case and would not be out of line sending them a certified letter referencing the offer letter representing a contract they are about to violate. The V.P. by the way, whenever there is an issue with a newly delivered vehicle is big on asking "what was in the contract, that's all we're responsible for." But clearly the same does not apply when it's not in his best interest as he clearly intends to vioate what I consider to be a contract. When I gave my notice, incidentally, my resignation letter referenced this offer letter from 7 years ago and the commission issue and we discussed it verbally and it was not presented as being an issue.
Just curious if anyone else who is in sales has experienced this in their career. I have a SUBSTANTIAL amount of money at stake here. Let's just say tens of thousands. My new job has less salary than I would have liked but represents a good move due to the possibility of upward mobility. I took this job knowing this substantial amount of money was still coming from my former employer and if it doesn't I'm screwed financially. Thanks, Brian
