There is definitely a difference in customs from state-to-state. In Illinois it is definitely the custom to put an inspection contingency, in writing in the contract. By the way, everywhere requires that all contractual provisions dealing with real estate in writing. An oral promise is worth exactly the same value as the paper on which it was printed. ($0.00)
Wisconsin, I understand, the custom is to not inspect at all. But that just means the real estate agents, who all get paid by the seller, and only get paid if the sale goes through look at you funny when you ask. Just because they haven't seen it in their "form" contract doesn't mean you can't have a binding contingency that says: "We agree to buy for $X,000,000, but only after our lawyer approves and there is a home inspection" wouldn't be legally enforceable, just that they market isn't used to seeing it.
A lawyer, at least, gets paid to give you advice, not to close the deal. That doesn't mean they are perfect, some think they need to yell or screw up deals to earn their fee, but at least their loyalty isn't compromised by having to make the deal go through to earn their commission. Which also doesn't mean that there aren't real estate agents who work really hard, just that you need a good one to be sure they do the work for you, not for the party paying the commission (which is not the buyer).
