You're kinda' screwed either way. You're not allowed to charge a surcharge so you post a sign on your visa accepted sign that says $5,000 limit per transaction. For amounts over that then folks know there is indeed an expensive, commonly valued at 3% though actual merchant rates are somewhat lower. So after $5,000 the purchase price includes any surcharge, un-itemized separately, and you the merchant can decide if you can take the hit. Or you can negotiate a fee, but I think you cross some kind of a credit card agreement line. There are still gas stations with cash and credit prices and fees for using your debit card so I wonder what the exact laws are.
That's how we do it here at the motorcycle shop. You point out the limit to the customer and then the close is if you'll do it we'll take the whole thing on the card.....works every time.
Also I like the check protection that taking an amount up to $5,000 on the card provides. That is if someone wants to write you a $20,000 check and they don't have a credit card they can "get the miles on" for $5k then I'm suspicious. I haven't any check problems with people who can give $5k on a card, or at least a $500-1,000 deposit on a credit card. Pretty dumb to write a rubber check after you've given money on your credit card.
