I'd go ahead and file a complaint with Ebay. What you paid for was not just DIC, but a DIC WITH a 60-day warranty (that is not being honored). Therefore, the vendor has not delivered what he advertised. This alone is absolutely a legitimate grounds for envoking your buyer protection rights under Ebay's policies.
Additionally, I NEVER buy anything through Paypal that costs more than $25 by drawing funds from my bank account. I ALWAYS use the credit card option for larger purchases. This enables me to not only use EBay/PayPal's protections, but also enables me to envoke the dispute resolution protections afforded by the Uniform Commercial Code (UCC). If you paid by credit card and the vendor is in the united states, you can have your credit card reverse the charges while the dispute is open.
If it turns out that this is a knock-off advertised as a genuine item, this is a slam dunk. The guy has committed fraud. The guy will have to take the return and refund your money or he won;t be able to trade on EBay again. I have had Paypal refund me up to about $120 on questionable behavior by a vendor, so it does work. Whether its a knock-off or genuine, the seller has still not delivered what he sold you.
You only have a limited time (45 days from the purchase, IIRC), so I'd file the complaint with EBay immediately if you still can. The worst they can do is reject your claim. You have no reason not to try. File a complaint today, even if you are beyond the 45 days - you can probably claim that his time is not up until the delivery is finished (that would be 60 days from the time you received the item. Always take the most liberal interpretation of the rules in your favor. They can always say no, but what does it cost you - five minutes of time to write the complaint? Seems like a pretty good cost benefit ratio to me.
