If there's a big deep dent in the middle of my door, it's difficult for someone to claim that I created it by backing into them. I'd have to slide my car sideways onto the corner of their bumper. OTOH, if there's a dent that's kind of a long slide that tapers in and out, they might have a better argument. We could comment better if you post a photo somewhere. Either way, the witness is likley the clincher.

If you don't have an independent agent (and you should... it cost nothing and you have someone to help you intelligently choose coverage and to help in situations like this), then I would suggest calling your state's insurance commissioner's office. They will usually have a consumer department that can advise you of the law and your rights - but not on your specific case. They can tell you about surcharges, threshholds, etc.

In every state I am familiar with you can always choose to sue rather than involve your insurance company - but if the other party tries to claim that you were responsible, then youmay have to get them involved. You insurer (even if you have to call direct) should always be willing to give you advice previous to filing a claim, but keeo in mind that it's probably tainted to what works best for them in accordance with your corporate policy. You can always call them and say "I was in a fender bender...need to know about filing... need to know my rights, etc". Don't give them anything specific about the accident until you are sure you want to file.
