GM is very good at litigation - seriously, they are probably better at litigating than building cars. They always have been good at it. The joke amongst plaintiff lawyers is that you only sue GM once in your career. While GM may eventually make a business judgment to settle the case and pay Spyker something, GM will certainly make the case as expensive and painful as possible for Spyker. Not just to weaken and damage Spyker further, but to serve as a warning to others not to bother trying. And if the case doesn't settle, Spyker has a tough case to proove - especially given the venue - GM's home turf - Federal Court in Detroit. Spyker should have brought the suit in Delaware where perhaps they stood And while Spyker hired a good firm, Patton Boggs, they are better known as a politically connected DC firm - which means nothing in Michigan. A Detroit jury will favor the home team - not Spyker. Should be fun watching it unfold.
