I think that in most cases the lawyer views the activity as a challenge, irrespective of the guilt/innocence/lack of culpability of the defendant. This is probably necessary anyway, because if you know a guy is stinking rotten guilty to start with, you have no other choice but to find some piece of information that you can use as a defense. I do not believe that most lawyers are inherently dishonest, I believe that they are, for the most part, more intelligent than the average person, and posess sharper wits, and use these traits to perform their jobs as well as possible. There's hardly anything wrong with that, at least not in my opinion. Of course there are few unscrupulous lawyers, just like unscrupulous mechanics, car dealers, builders, doctors, anybody else who can abuse their professional position to take a buck from an unsuspecting chump. I do think that it is unfortunate that some Criminal Cases are 'over prosecuted' - the defendant charged with 1st degree murder when involuntary manslaughter would be more appropriate. I know that the reason for doing this to improve the likelihood fo a guilty plea on a lesser charge, and hence a successful outcome. I do think that the proportion of people charged and ultimately convicted of an offence is 90-something % right. By this, I mean I don't think there are too many innocent people wrongly convicted, though of course there are a few.

Coming back to using a difficult childhood etc. as a defense, I think the lawyer is just doing what he/she believes to be the best possible job to work for his/her client. No professional standard in the world would expect anything less, it's just in this case it gets a bit touchy. It's kind of like a business giving preferential treatment to their best customers... nobody usually has an issue with this, except at the bank, when all of a sudden Joe Millionaire in getting pulled out of the line by the Manager so he doesn't have to wait to make his deposit, while Joe Excavator Driver has to stand in line for 20 minutes...

No, I'm not a lawyer, but I do play one on TV. lol
