My boyfriend lives in Montreal and I live in New England so I go across the border a lot. It doesn't matter if your stuff is purchased, traded, found, or what... if you bring something back that you didn't come over with and the dude at the border estimates that it is of a value that exceeds the limit, you just might be paying. Basically, it is on your honor, unless you've got something that would be unreasonable with to just be travelling around with. For example, I tried to bring back a computer moniter the last time I went up for the weekend... it was originally my boyfriend's computer moniter and he wanted to me take it to his sister in Connecticut. I declared it and the guy at the border looked at the back to see what year it was made and saw that it was from 1999 or something and decided that it was OK. My boyfriend has gotten harassed lots of times for bringing stuff like used tires and tools and parts, which are hard for the border people to place a value on, but they look like stuff with some value because they are useful. On the other hand, there is no reason why a Canadian can't go to the US to buy a diamond ring or whatever and pay a half of the taxes over what they'd pay in Canada and act like they've always had it. The system doesn't make much sense but I guess it's the only way to do it. Hope that helps.
