Without the catalytic convertor, it is unlikely the car would pass any emissions test. It might, but low probability.
I'm not sure of the legality of removing the cat. That may depend on the state you live in. Of course, one could ask if you'd ever be inspected.
In my state (CT), there is an emissions test. They also physically inspect the vehicle to make sure the cat is there.
Removing the cat would result in the need for something to connect the two. Some folks 'gut the cat' - simply ram the guts out with a steel rod.
There may be a slight performance improvement without the cat or with a gutted cat. It will provide less backpressure.
Will the car pollute more without the cat? Probably/maybe. It depends on how your 14 year old car with some large number of miles is running. That is between you and your particular diety.
