Well that was an easy case. No one is allowed to sell a car without a valid smog test here in CA even though private parties may do it from time to time.
It is the sellers responsibility to provide a smog test, the dealer should know better.
Let the dealer handle it whichever way they want to as long as it is passed when you get it back.
Well, as I said, sometimes the computer refuses to set the flags due to that some wrong parts are installed and before checking those things it is difficult to tell the status of your car.
Also, a HUGE factor is that most States DIDN'T check for readiness status about 4-5 years ago. That's why most of these cars passed with flying colors up until recently.
Even though the OBD 2 system came along in 96, it was in the beginning of 2000 that some States started to test for readiness status, CA being the first as usual.
