Ditto the first two posts. Regardless of your driving record if he was charged and you have the police report to verify it, the accident should not be a chargeable offense for you. You should speak with your insurance people in detail about pursuing compensation from his company and making sure you don't get screwed.
A few years back I was involved in a similar accident here in Virginia while I had a few points on my license. My insurance company considered it a non-chargeable offense for me and my rates never changed. I'm no expert on insurance and I know sometimes things vary state-to-state, but you should be aggressive and make sure you don't get the short end of the stick.
You might also want to consider the option of totalling the car. Based on the miles that might be a desireable alternative. I had that option, chose to have the car repaired (not a SAAB), and totally regretted it as it was never the same.
Good luck!
Ron
