Not certain what state you are in, but I am only insurance licensed in PA. Insurance policies vary from state to state, and company to company. Your agent should be able to counsel you as to your options, and the potential fiancial consequences. Depending on the coverage you have, the other company will typically not pay for things you weren't covered for (i.e rental car). In most states, rental car coverage is paid, along with other expenses by your company, and then your company subrogates against the at-fault driver's insurance carrier to recover their expenses for the claim. You would sign a subrogation waiver stating that you have then waived all rights to seek further compensation on the claim. At the very least, you should know that if you dispute the claim payment, you have a right to bring in your own claims adjuster (paid from your pocket) to handle any claim disagreement. If you really are concerned about your rights, seek legal advice early (again out of your pocket). Depending on the depreciation assessed on the claim, $5k will more than likely total the car. You would have the right typically, to buy the car back for the salvage value, rebuild the car, but be left with a reconstructed title (except in some states) which would have an impact on selling the car in the future. While these are just talking points, you want professional advice that applies to your given situation in your state of residence. People not in the insurance , legal or appraisal business are only giving you their layman's opinions which can be dangerous and expensive. Hope this helps. Count yourself lucky that you weren't in a state that applies the 1% rule.
