I forgot what state you are in - NY? If I recall correctly, here in Illinois the state can suspend your license for more than 25 over the limit! I would not go to court here without competent legal assistance, don't know the rules where you are. A couple hundred bucks of legal fees might be money well spent. If you are a member of a motor club, you may have a benefit that covers part of it.
In any case, if you have an insurance agent that your family has been using for some time, you may want to give him/her a call and discuss the situation, without giving too much detail if you are paranoid about what they might do with it. My agent, who I have been using for 15+ years, values my business (he makes a commission every year on my policies, whether he does any work or not!) and will actually evaluate some of the options for me on questionable claims I have, i.e. worth making a claim on minor body damage.
