Mostly his problem, not yours Posted by Ari [Email] (#2847) [Profile/Gallery] (more from Ari) on Thu, 24 Feb 2005 07:59:54 In Reply to: ever sell a car out-ot-state?, JimBlake [Profile/Gallery] , Thu, 24 Feb 2005 06:10:02 Members do not see ads below this line. - Help Keep This Site Online - Signup |
Let's assume that you have a ride home, and that you've addressed any security concerns (bring Big Bubba along for company). And you've got the payment part covered.
Once you give the buyer the title and get the money, you're done. You take the plates off the car, and it's up to the buyer to get it home. He's got a few choices-
(1) He can ask you to leave your plates on the car while he drives home. DO NOT DO THIS! I think this is pretty obvious, but I felt the need to say it.
(2) He can throw some plates of his own on the car and drive it home. Depending on the plates, this may or may not be legal. Maybe he has Transport or Dealer plates. If so, it's legal. Maybe they're the plates off his mother's Buick. That would be illegal. However, IT IS NOT YOUR PROBLEM. You have sold the car. You no longer hold title, and with the plates removed and title signed over ,the car is no longer registered in your name. Your registration on that car is invalid.
When I have been in this position, I have done it a few ways. All are legal. Usually, I get the owner to drive the car to my house. They leave the car, and take the plates. The car is always legally registered on the road. Then, with the title in hand, I go to MVD and register the car. If it needs inspection, MVD will issue temporary plates.
In another case, the buyer was a dealer, and delivered the car on a flatbed right to MVD, where I registered it on the spot.
In most cases, the buyer needs the signed-over title to register the car. So he could take the title, leave the car where it is without plates, drive back to his home state MVD, register it, and drive back. Not great, but that's his issue.
Most folks I know will borrow the plates off another car, and drive home on those plates. As far as I know, that is illegal and stupid on many levels. The car is not registered, and as such, is uninsured.
So it is nice of you to worry about these problems of your buyer, but they are not yours to fix. Whatever you do, don't let him take the car with your plates on it. Even if you've signed over the title, you would have some legal exposure. And if he hits the Trial Laywer's Association Day Care Center bus on the way home, you'll be very unhappy.
