I'm from state of Michigan, where there is actually a deer hunting day, sometime in middle of November (opening day for rifle), where most plants have hard time running their assembly lines...
I've yet to hit one. But I've asked my insurance agent, what would happen on the insurance settlement where I swerve to avoid the animal and caused an accident (property/vehicle/personal). It would be deemed my fault and I'd be responsible to pay the full deductible. My insurance would cover the damages up to their limits. (Michigan has no-fault insurance.) And my insurance rate would go up.
Now suppose I don't swerve and hit the deer. This would most likely cause damage to my car. But insurance would look at it as act of nature and would not fault me. I may have to pay deductible, depending on coverage, but rate wouldn't go up.
So the conclusion is don't swerve. May be just straight line braking, as long as there is no one tail gating you. But you are better off hitting the animal, according to the insurance laws in the state of Michigan.
