I'm no lawyer and don't know jack about Canadian insurance, but if this happend to me in Washington State, I'd take the person who hit me to small claims court. In Washington we can file a claim for up to $2500 US, it only costs about $35 to file it and neither side can use a lawyer which saves $$$$. The insurance company only steps up to the liability of the person who hit you so they would have to pay any settlement you get from the court. All you have to do is get your documentation of who is at fault (no issue with a rear ender) and how much you lost (apparisal from someone who sells Saabs). It's a little work, but a simple procedure you can do yourself. Frankly, if I were Dave, I would have hired a cheap lawyer to show my appraisal to the insurance company. In the US we have more attorneys per capita than any other country in the world and there are a lot just starting out who would like this work and it's pretty simple stuff. Remember that insurance company's have any particular authority to decide how much you are going to get in a settlement. Quite the contrary, they make money by collecting premiums and not paying claims. If you don't think you are getting fair treatment stand up to these guys. Same thing happend to me when my Datsun roadster was rear ended a few years ago. Some jerk insurance adjuster tried to tell me it was only worth half of what I knew it was worth. I just got a couple of car lots to tell me what I'd have to pay to replace it and presented this to the insurance company along with the observation that my neck was pretty sore. This adjuster's boss saw things my way.
