Hello Todd,

I used to be an insurance adjuster so allow me to offer my perspective on your issue.

I am guessing it was the adjuster who looked at your car who made the decision that the damage was not related. Did he tell you how he arrived at that conclusion?

On a damage such as what you're claiming, an experienced adjuster would leave it "open" (meaning your claim to the damage seat control) until such a time it could be inspected and somewhat accurately determined if it is new or old damage. (A newly broken plastic piece is easy enough to recognize from an old one.)

It might be useful for you to know that Insurance adjusters are typically not auto mechanics and are mostly schooled in body damage/repairs only.

On something like the mechanicals of a power seat, the call he/she made in denying your claim was a hasty judgment.

Incidentally you did make the point that the seat was operating normally prior to the collision?

That said, I would contact his Claims Manager and explain the situation to him or her.

I am reasonably confident that if you can show that it is "new" damage he would be willing to replace it with an LKQ. (Like, kind in quality, in short a used one). And by the way, make sure they include installation labor in the settlement.

In your exchange you should also mention that because the seat cannot be adjusted to the correct position, it is in your opinion, which incidentally is shared by your Uncle who is a lawyer, that at its present state, your vehicle is not safe to drive.

Subsequently you would have to have a rental. (Insurance co's. in general don't like lawyers and the mere mention that you could conceivably involve one always makes them amenable to a compromise).

In addition the idea that the damage may now escalate because of the rental, will further motivate the CM to settle.

Hopefully this information helps, even in some small way.
