Rebuilt versus new gear box on 99 9-3, what's the best?

I have a rebuilt transmission since December 00 and it's making a "gear whynning or whistling" as if there was no oil, but there's no leak. It's about the same sound than when you back up, but with less intensity.
The car going back to the dealer next week for the 20K service.
There's also a clinch when shifting from 1 to 2 in cold weather / cold start.
Should I ask for a brand new transmission or a 2nd rebuilt tranny?
Any advice will be appreciated.
