Wierd Shift and Loss of Power

I have been getting a wierd shift between 2nd and 3rd around 50 mph on my '01 9³ SE auto 12k miles. With medium hard acceleration (constant pedal position), it lurches, then pauses, lurches and pauses (kind of a hesitate and lunge trying to decide what gear to be in). I took it in, but of course they could not duplicate it so they dismissed it. I have also noticed a loss of performance at higher speeds passing on the freeway.
Anyone else run into this? Any ideas?
