I thought this is a more appropriate forum to talk about the accident my younger son was involved two weeks ago which totaled our 95 9kcse. See link to my prior post on the 9k forum.
There was a little twist to it. My son got the police report last week. To his surprise the police placed the blame on him in the report and gave hime a ticket for improper passing. In the report he drew the position of the car to be clear behind the truck on the right lane. His contention was my son should have yielded the right of way to the truck allowing him to switch lane.
I am currently traveling out of the country.
The police arrived at the scene after the accident. Wrote the report based, I think, on my son and the other driver's account. Fact is the 9k was along side of the truck when it switched lane. The dent on the driver side rear quarter panel proves this. Although the front fender and bumper suffered more severe damage. The car ahead of the 9k passed the truck, clearing enough space for my son to catch up. He accelerated attempting to pass. But when the truck swerved to the right my son did not have time to react, thus the collision.
A couple days after the police report was issued, we received at least three ambulance chasers soliciting business. No surprises there. I told my son to talk to the lawyers on initial free consultation with the evidence. I think with the evidence we have we can show the police officer was wrong. I was also expecting the other party to refuse payment after seeing the police report.
My son call me earlier the other party's insurance handler is coming to our house with the full payment. he is fully aware of the police report. I told my son to sign for the two checks but don't cash them yet.
Of course he would still need to clear his name in court with the township police.
