for sure, there is a good amount of wasted effort associated with patents. I can't elaborate too much, but I can say I've reviewed my share of junk patents, and that in itself is a waste of engineering resources... the defensive patents are one of those things that are good for the company issuing them, but not great for advancement... certainly it's a game, and as you say, the merits of that game is debatably dubious (depending on one's vantage point)... that there can be downsides doesn't mean there are not pros (I find your vantage points often throw the baby out with the bath water)... I've certainly observed a successful lawsuit directed at a company that blatantly stole IP from another (the principles of the copycat left the original to start the copycat - copycat was put out of business - VC's pulled the plug among other things), and rightly so: IP costs to produce, and imho it's an expectation of investors that IP is protected, otherwise, investment would be too risky... and again, IP protection via secrecy + NDAs (I suppose your preferred route) can often be advantageous to patents... just not in *every* case...
wrt Shakespeare... I guess I thought almost all his plays blatantly "borrowed" plots from the greek/roman literature (I suppose second hand from his pub mates!)... pretty much how university students do papers! haha...
