I was rear-ended in NY. Their insurance company sent an agent to do an assessment of the damage. They determined the the value of the car was less than the cost to repair. They told me they would write a check to me for the value of the car on the spot. The told me I could remove my personal belongings and they would tow the car away.
I told them that I would like to keep the car.
They said that I could keep the car, but the value of the check would be reduced by the value that a salvage yard would pay for the car.
They printed a check on the spot. I drove my car to the bank and cashed the check and then went home and made some minor repairs to my car. There was no record of change to the status of my title (ie: No Salvage Title) I drove the car for a couple more years before retiring it to parts car status.

BTW the car is a 1990, photo from a few years ago
