Call him first and verify its not miscommunication, etc.... If you find he is indeed not going to give you your money back or merchandise tell him you are going to file a mail fraud report on him. The papers can be downloaded from the usps.com. This is a serious charge with serious ramifications, so make that clear to him also....If he stilll does not cooperate throw the book at him via mail fraud....
I had the same thing happened followed the same steps and was paid back via paypal the same day.
