Is it only Mass that has these terrible liability laws? I was in a similar situation last year where my old Nissan was totalled, and the other driver was found to be 100% "at fault" but we were found to be 20% "liable" for the damage, and therefore the other guy's ins. would only pay for 80% of the value of the car. The other guy pulled out onto a major road, thus appearing in front of us when we were going about 35mph, and to avoid hitting the driver's side door head on, we swerved and hit the rear end of his car. Thanks to Massachusetts @#!*$%&! rear-end collision law, this is how we ended up being "liable" (though it's true that our ins. did not go up, because we were not "at fault"). We fought this like crazy but I'm sorry to say we lost. (Very long story involving the president of the other guy's insurance co and the Mass. State Attorney General's office and so on.) Strikes me as a deeply flawed law which provides more protection for the insurance companies than it does for the consumers.
