Well I brought my car to the auto body place today and of course they agreed with me that the quarter panel should be replaced. In fact while I was there they called the adjuster to come back out so that they can persuade him to "see the light". The adjuster for my insurance company was not the brightest individual in the world and actually quite rude. I was glad to hear that another adjsuter was coming out to look at the car, instead of the other jerk. Now my only concearn is that my insurance company will go along with the body shop's reccomendation - which in my opinion is the correct one.

My other concearn is that the moron that hit me, says that I hit him. Well that did not happen, he attempted to take a right from the left lane (two lane road and I am in the right lane). He also came from behind, i.e. was never in front of me or next to me. I think he was trying to get to the entrance of a shopping plaza that was to my right - but clearly misjuged the distance and slammed into the rear quarter panel driverside of my car. The jerk has still not reported the accident as he was driving his wife's car and who knows if he is insured on her car. I do know that the car that he was driving is insured - the registration refelcted so and the police verified it for me (they showed up 20 min after the accident and were of no use, i.e. no reports filed). I have called Liberty Mutual (they are the insurance company for the other car) and I filed the claim for the jerk and his wife. Now Liberty is telling me that they can't find the policy?? What does that mean??? I believe it is Massachusetts law that your car must be insured and the MA State Police did not tell me otherwise. I have even brought my car to Liberty to have them look at it by taking pictures, the adjuster for Liberty was like "clearly you got hit, you would have to be driving backwards at an angle for this kind of hit to your car." Bottom line is that the other person is at fault and not accepting blame at this time, nor does it seem like the insurace company for the insured on the vehicle is able to locate the policy. I feel like this is more complicated than it needs to be? What do I do in this situation???? Sorry for the long winded story, I am very frustrated.
