Always call the cops. Being a nice guy in auto accidents always means you get screwed IMHE. Always make a clear statement to the cop at the scene showing that you were not at fault. As long as the cop writes it down (a problem in itself), the insurance companies and the Judge if you end up in court value that highly.

You may be seriously screwed unless you have uninsured motorist coverage. Even then, you may have an uphill battle. Call your agent and see what he says. You best option _now_ is for her to pay you for the damages directly. I think all the other approaches are going to be a litle or a lot of extra work on your part - if they ever pay off. Good luck collecting.
