Forgive me, John, for belaboring this point. I'm not trying to win an argument on an obscure point. Rather, I'm honestly trying to learn something.
In my experience with local dealer service departments (Saab and otherwise) when I drop the car off, I sign a contract agreeing to pay them for certain specified services, like an oil change or tire rotation. The contract also says that if I ask them to diagnose a problem, and subsequently decline to have the required repairs made, I may be subject to a diagnostic fee. After that, everything is handled by phone. They never ask me to stop by the dealership again to sign papers authorizing an expensive repair. I just have to pay the bill before they will give my car back to me.
That being the case, if I were involved, the following telephone conversation would have taken place:
Dave: "Hello, this is Dave."
Sven: "Hi, Dave, this is Sven from Saab Service. Your car needs a new ECU. It's $863."
Dave: "Eight Hundred Sixty Three Dollars!?? I just bought that car last month, and now it needs a part for $863? How come you guys didn't find that in your extensive inspection of the car before you sold it to me?"
Sven: "Well, it was OK when we inspected it. It failed after you got it home. But don't worry, I've called the extended warranty company, and they will pay for it."
Dave: "That's good, because I sure can't afford another $863 after just paying $X,XXX for the car and another $Y,YYY for the extended warranty. Well, as long as it's covered, go ahead and make the repair."
Perhaps none of that conversation (which I took great pains to slant my way) is relevant. But there is still no written contract in which I authorize them to repair anything, just an agreement that they will provide me with a diagnosis. They subsequently told me by phone that the repairs were covered by the warranty company, and on that basis I authorized the repairs. Furthermore, they gave me the car back, which on every previous occasion that I've done business with them has been an indication that my bill is paid in full.
If Cal signed a contract like the one I've described, and if such a conversation subsequently took place, what is Cal's contractual obligation to the dealership? Note that we're discussing the contract between Cal and the dealer, not the one between Cal and the warranty company.
Thanks for indulging me on this. As I say, I'm trying to learn something, not trying to win an argument.
