It is probably illegal under US regulations and it is clearly illegal in most of Europe (including Germany). Doesn't matter if it is low visiblity your brake lights will produce less of a contrast if 2 rear fogs are used. You want others to see you (thus the rear fog) but you don't want any delay in their recognition that your braking either. The European's have 4 decades experience with rear foglights and are the leaders in lighting systems. Follow their example.
Side note, German law also requires that visibility be reduced to 50 meters or less before rear foglights are activated.
