A good point well stated.
I agree that the concept is inherent in our laws, I agree that some attornies do good work on behalf of injured clients. I feel it is wrong for an attorney to use the letter of the law to pervert the intent of the law, especially on a profit sharing basis after steering jury selection to a favorable outcome. I doubt the Justinian codes forsaw legal facts 2,000 years ahead of time, so some reasoning should be applied to limit or update the application. But judges hate to have appellate courts overrule them.
If I lend my car to a habitual drunk to go out drinking and he gets drunk and injures someone with it, I should be held liable as I could foresee the consequences and chose not to help prevent an injury. A leasing company is set up to own and rent its assets on a for profit basis; it cannot forsee or control all of the situations where its assets may be used.
An attorney's use of the tenent in the common law, on a commission basis, playing to niave jurors prone to making emotional decisions rather than rational ones based on fact is wrong. Technically legal? Sure. Right? No. The consequence is interference in commerce. Depends on what your definition of "is" is, I guess.
